While we strive to ensure smooth transactions, disputes may occasionally arise. This section outlines the procedures for resolving disputes between clients and freelancers.

1. Initial Dispute Resolution

• 1.1 Direct Negotiation
  Clients and freelancers are encouraged to resolve disputes directly through open and honest communication. Often, misunderstandings can be cleared up with a simple conversation. This is the best way to resolve issues with mutual understanding.
• 1.2 Escalation to Yozarr.com
  If direct negotiation fails, either party may escalate the dispute to Yozarr.com by submitting a formal dispute resolution request. Disputes regarding billing or services provided should be communicated to the management. This request must include:
  • A detailed description of the issue.
  • Relevant communication records.
  • Any supporting documentation or evidence.

2. Mediation by Yozarr.com

• 2.1 Review Process
  Yozarr.com will review the submitted dispute resolution request, including all provided documentation and evidence.
• 2.2 Mediation Process
  Yozarr.com will mediate the dispute by facilitating communication between the client and the freelancer. Both parties may be required to provide additional information or clarification.
• 2.3 Resolution and Decision
  Yozarr.com will propose a resolution based on the information provided. This resolution may include partial or full refunds, adjustments to the project scope, or other appropriate actions. Decisions made by Yozarr.com are binding and final.

3. By Judicial Process

• 3.1 Binding Arbitration
  If mediation does not resolve the dispute, either party may request binding arbitration. Arbitration will be conducted by an independent third-party arbitrator selected by Yozarr.com. The arbitrator’s decision will be final and enforceable by law.
• 3.2 Judicial Fees
  If the platform’s dispute resolution team is unable to resolve the issue satisfactorily, the matter will be referred to the appropriate judicial authority. Both parties agree to submit to the jurisdiction of the courts designated by the platform for such matters. Initially, judicial fees and expenses will be borne by both parties. If one party is determined to be the prevailing party, that party will be entitled to a refund of their judicial fees from the non-prevailing party. The platform will not be held liable for any legal costs or outcomes arising from judicial review.

3.3 Jurisdiction Location
All disputes arising out of or in connection with this agreement shall be governed by the laws of India. The parties agree to submit to the exclusive jurisdiction of the courts located in New Delhi, India. In the event of a dispute involving parties located outside India, the parties agree to follow the dispute resolution process as outlined in these terms, and any judicial review will be conducted in accordance with the laws of India.
